The Dublin Regulation

The Dublin Regulation (Regulation no. 604/2013) is an agreement between the EU Member States, Norway, Switzerland, Iceland, Liechtenstein and Denmark (the Member States) that is intended to ensure that an asylum application submitted in one of these countries is only considered in one country.

If you have received a decision from the Immigration Service requiring your return/transfer to another Member State and do not wish to file an appeal against this decision, you are a returnee.

You are also a returnee if you have filed an appeal against a decision by the Immigration Service, and, having made a final decision, the Danish Refugee Appeals Board agrees with the Danish Immigration Service’s decision regarding transfer/return.

The Danish Immigration Service transfers your case to the Danish Return Agency when you are a returnee. The Danish Return Agency will then call you for an interview. This interview will concern the planning of your return and an explanation of the Danish Immigration Service’s decision regarding your transfer to another Member State, if relevant. You will receive information about such matters as the practical return procedure, including baggage rules, etc.

After the interview, a date for your departure from Denmark will be set.

The Danish Return Agency will assist with your departure from Denmark by issuing travel documents and ordering a ticket. As a general rule, you will receive a letter setting out practical details about your journey such as departure time and where and when to appear. The Danish Return Agency is also charged with receiving persons being returned/transferred to Denmark from other Member States in cases where the Danish Immigration Service has accepted a request to readmit or take charge of the person concerned to Denmark. If you are to be transferred from another Member State to Denmark, a Return Agency representative will meet you at the airport. Here you will receive information about where you will stay, transport to your place of stay and any obligations to which you are subject.

The Danish Immigration Service decides whether you are to be returned/transferred to another Member State to have your application for asylum considered there.

The Danish Return Agency is charged with effecting the Danish Immigration Service’s decision regarding your return/transfer to another Member State.

Accordingly, it is the Agency’s task to send you to the Member State that is to consider your application for asylum.
